Can I leave records out of a data license?

Exclusions should be defined and agreed before sampling or delivery. A provider may accept a narrower package, change its proposed price or decide it is not useful.

The short answer

Exclusions should be defined and agreed before sampling or delivery. A provider may accept a narrower package, change its proposed price or decide it is not useful.

Name concrete boundaries

Identify projects, customers, dates, fields and record categories that must stay out. Include attachments and linked records so an excluded item is not accidentally reintroduced elsewhere.

Test the exclusion process

Ask who implements and verifies filtering. Retain an export manifest and have the final package reviewed. A contractual exclusion is less useful when the actual export cannot reliably enforce it.

What to record before deciding

Keep the written scope, official provider source, unresolved questions and the person responsible for each check. Treat a marketing claim as a claim until it is reflected in the agreement. A directory entry does not approve the transaction or establish your rights to share the records.

Your next step

See where your company’s data could fit.

  • Begin with a company description, not an export
  • Review systems, retained history and exclusions
  • Compare the terms before sharing records
